Terms of Service
These terms cover every app made by Peridex Studios LLC. Part A applies to all of them. Part B holds the extra rules for each individual game.
You must be 13 or older (or the age of digital consent where you live, if higher).
Play fairly. Cheating, hacking and abuse can get scores removed and accounts closed.
In-game currency and items are a license to use them in the game, not property, and have no cash value.
Purchases go through Google Play. Refunds are covered by each game's refund policy, and nothing here limits your legal rights.
Part A. Terms for all our games
1. Who we are and what this covers
These terms are between you and Peridex Studios LLC, a limited liability company based in New Jersey, USA ("we", "us"). They apply to every game and app we publish (each a "Game"), and to the websites and support services that go with them. By downloading or playing a Game you agree to these terms. If you do not agree, please do not play. Each Game also has a privacy policy, and some have a refund policy. Those are part of how we deal with you, and the links are in the Game's settings and store page.
2. Who can play
You must be at least 13 years old, or older if the age of digital consent where you live is higher. If you are under the age of majority where you live, you need a parent or guardian's permission to play, and especially to buy anything. A parent or guardian who allows a minor to play accepts these terms for them.
3. Your account
Our Games sign you in automatically with an anonymous account. You may link a Google account where a Game offers it, so you can recover your progress on a new phone. You are responsible for what happens on your account and for keeping your device and any linked account secure. Do not sell, trade or give your account to someone else.
4. Fair play and conduct
Play the Game as it is meant to be played. You must not:
use cheats, hacks, bots, scripts, modified apps, emulated or tampered devices, or any other method to gain an unfair advantage, to fake a score or time, or to obtain currency or items you have not earned or paid for;
attack, probe, overload or reverse engineer our servers or the Game, or look for ways to bypass its protections, except where the law says you may;
choose a display name or profile that is offensive, hateful, sexual, misleading, or that impersonates another person or Peridex Studios, or that shares personal information;
harass other players or use the Game to break the law; or
exploit a bug or error to your advantage instead of reporting it to us.
We decide what counts as unfair play, using our servers' records. We may remove or reset scores and rankings, change a display name, withhold or remove currency and items obtained unfairly, and suspend or close an account, with or without warning where the breach is serious. If you think we got it wrong, email us and we will look again.
5. Virtual currency and items
Our Games may include virtual currency, such as Fragments or Lumina, and virtual items such as skins, trails and name plates ("virtual goods"). You can earn them by playing, receive them as gifts, or buy them.
A licence, not ownership. We give you a personal, limited, non-transferable, revocable licence to use virtual goods inside the Game that issued them. You do not own them.
No cash value. Virtual goods cannot be exchanged for money or anything of real-world value, and cannot be sold, traded or transferred to another account, inside or outside the Game. Any attempt to do so is a breach of these terms.
The server decides. Balances and purchases are kept on our servers. If what your device shows disagrees with our records, our records are correct, and we will correct any genuine mistake in your favour.
Prices and stock can change. We may add, change, reprice, rotate or remove items and set amounts for currency packs at any time. Things you already have are not taken away because of that, except as described below.
Loss. Virtual goods end when your account is deleted or closed under these terms, or if a Game is shut down (see section 9).
6. Purchases and refunds
Purchases are made through Google Play and are subject to Google Play's own terms. Google Play is the seller of record, and charges your payment method. Each Game's refund policy explains the refund route and what we do if something you paid for does not arrive. Where a purchase is refunded or reversed, we may remove what it bought and any currency that came with it, and where you have already spent that currency, we may take the balance below zero until it is repaid. Nothing in this section or in a refund policy limits your statutory rights (see section 12).
7. Ads
Some Games show ads, supplied by Google AdMob and its partners. Where a Game offers a way to remove ads or to watch an ad for a reward, the Game explains what it does. Ad choices and consent are described in the Game's privacy policy. Do not click ads fraudulently or help anyone else to.
8. Our content and your content
The Games, including their code, art, music, sound, names and logos, belong to Peridex Studios LLC or our licensors and are protected by law. You may play the Game for your own personal, non-commercial use, and nothing else is licensed to you.
Your display name and any other content you put into a Game remain yours, but you give us a free, worldwide right to show it inside the Game and our related services (for example on a leaderboard) for as long as it is there. You promise you have the right to use it.
If you send us feedback or ideas, we may use them without owing you anything.
9. Changes, updates and shutting a Game down
Games change. We may update, rebalance, add or remove features, and we may stop supporting a Game or a version of it. If we shut a Game down, we will give reasonable notice where we can, in the Game or on its store page. Where we close a Game that has virtual goods you bought and have not used, we will handle that fairly and in line with the law.
10. Suspension and ending
You may stop playing at any time, and delete your account using the steps in the Game's settings. We may suspend or close your account for breaking these terms, as described in section 4. When an account ends, your right to use its virtual goods ends with it.
11. No guarantees, and limits on our liability
We try to keep our Games running and fair, but they are provided "as is" and "as available". We do not promise they will be free of errors, interruptions or data loss, or work on every device.
To the extent the law allows, Peridex Studios LLC is not liable for indirect or consequential losses, lost progress, or lost virtual goods, and our total liability to you for any claim relating to a Game is limited to the amount you paid us for that Game in the 12 months before the claim.
Nothing in these terms limits or excludes liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to exclude.
12. Your legal rights
If you are a consumer, you have rights under the law of the place you live, including rights about digital content that is faulty, not as described or not fit for purpose. These terms do not take those rights away, and where the law gives you more than these terms do, the law wins. This includes the right to bring a claim in the courts of your own country where the law gives you that right.
13. Governing law
Unless the law of your country requires otherwise, these terms and any dispute about them or a Game are governed by the laws of the State of New Jersey, USA, without regard to its conflict of laws rules, and the state and federal courts located in New Jersey will have jurisdiction.
14. Changes to these terms
We will add Games to this page and may change the terms as our Games and the law change. We will post the new version here with a new effective date. For significant changes we will tell you in a Game or on its store page. If you keep playing after a change takes effect, you accept the new terms. If you do not, you can stop playing and delete your account.

Part B. Rules for each game
Each section below applies only to the named Game, on top of Part A. If a Game's rule here conflicts with Part A for that Game, this section wins.
Neon Dodger
Privacy policy · Refund policy · Deleting your account
Leaderboard. Your display name, scores and ranks are public to other players. Scores are checked by our servers. A score that is impossible for the time played, or that we judge to come from cheating, is dropped, often without a message, and may be removed later. A name that breaks section 4 may be changed.
Fragments. Fragments are earned by playing. The amount a run pays is worked out on our servers from real play time and the difficulty you played, not by the app. Earnings slow after heavy play within a day, and there is an overall daily limit to prevent abuse. We may adjust earning rates, and amounts you have already earned stay yours, subject to section 5.
Lumina. Lumina is a second, premium currency that can be earned through some achievements and gifts, or obtained by converting Fragments. Some items are priced in it. It has no cash value and is covered by section 5 in the same way as Fragments.
Items and exclusives. Skins, trails and name plates are cosmetic only. Nothing you can buy changes how a run plays or how scores are counted, so there is no advantage in paying. Some items can only be earned, and some are offered for a limited time or in bundles. We may retire an item from sale.
Rewards, mail and challenges. Daily challenges, achievement rewards and mailbox gifts are paid once, by our servers. Some gifts expire, and refunds owed to you never do. A reward obtained through a bug or cheating may be removed.
Season pass and special offers. If we offer a season pass, welcome pack or similar, the offer's screen states what it contains and how long it lasts. Time-limited offers are timed by our servers, not by your phone's clock. A refunded purchase also removes what it granted, as set out in section 6.
Remove Ads. Remove Ads stops the full-screen ads between rounds. Ads you choose to watch, such as to revive a run, stay available. If you get a new device, use the Game's RESTORE PURCHASES button with the same Google Play account.
Cloud save. Linking a Google account saves your progress so you can restore it. Fragments, Lumina and purchases are held by our servers and come back through your account, not through the save file.
